This bill is substantially similar to Bill 19, An Act respecting health and social services information and amending various legislative provisions, which was tabled in December 2021 and thereafter died on the order paper.
The bill’s objectives for health and social services only appear valid on the condition that First Nations communities and organizations can benefit from the same access available to institutions in the health and social services sector so as to ensure the optimal use of information on their populations stored in the MSSS systems and systems in the MSSS network. The bill must also respect and preserve the autonomy of First Nations in matters of self-determination and information governance.
This brief outlines these issues and proposes certain measures that the Quebec government could put in place swiftly to ensure that Bill 3 meets the unique needs of First Nations.
