This joint brief (AFNQL and FNQLHSSC) explains the institutional and legislative context in which child and family services for First Nations in Quebec evolve. It also presents the unprecedented advances in federal legislation, An Act respecting First Nations, Inuit and Métis children, youth and families, which explicitly recognizes the inherent self-government rights of First Nations, including jurisdiction over child and family services, which includes the power to legislate to design, organize and implement their own services. This law constitutes a major step forward in terms of recognizing the right to self-determination of Indigenous peoples, while establishing national principles for all youth protection organizations, which they must apply and comply with.
